Welcome to House of Flame & Fantasy! The terms “we,” “us,” and “our” refer to House of Flame & Fantasy LLC. House of Flame & Fantasy operates this store and website, including related information, content, features, tools, products, and services (the “Services”). Our online store is powered by Shopify.

These Terms of Service (“Terms”), together with the policies referenced below, describe your rights and responsibilities when you use the Services. Please read them carefully.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing information, payment information, and shipping information. You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to display our products accurately. Colors and product appearance may vary depending on your device, screen settings, production method, and the nature of printed or manufactured goods.

Many House of Flame & Fantasy products are made to order. Minor variations that are normal to the production process may occur.

Product descriptions, availability, designs, colors, sizes, and other product details may be updated from time to time. We reserve the right to discontinue products or limit quantities where permitted by law.

SECTION 3 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. House of Flame & Fantasy reserves the right to accept or decline an order as permitted by law. Payment must be authorized and processed before an order can be fulfilled.

Please review your order carefully before submitting it, including the product, design, color, size, quantity, billing information, and shipping address.

If you need to request a cancellation, contact us as soon as possible at support@houseofflameandfantasy.com. Because our products are made to order and can enter fulfillment quickly, cancellation is not guaranteed once fulfillment or production has begun. If we are able to stop an order before fulfillment begins, we will cancel the order and issue the appropriate refund.

If we decline, change, or cancel an order, we will make reasonable efforts to notify you using the contact information provided with the order.

SECTION 4 - PRICES, BILLING, SHIPPING CHARGES, AND TAXES

Prices, discounts, and promotions may change without notice. The price charged for a product will be the price shown at the time the order is placed, subject to any valid discount or promotion applied at checkout.

Shipping charges and applicable taxes are calculated or displayed during checkout as applicable. Free standard U.S. shipping is available on qualifying orders over $75 before taxes and other applicable charges. U.S. orders that do not meet the threshold and international orders are charged the shipping rate displayed at checkout.

International customers may be responsible for customs duties, VAT, import taxes, or other fees required by the destination country. Unless expressly stated otherwise, these charges are the customer's responsibility.

You agree to provide current, complete, and accurate purchase and payment information and to use a payment method that you are authorized to use.

SECTION 5 - FULFILLMENT, SHIPPING, AND DELIVERY

Most products are made to order. Fulfillment or production time is separate from shipping transit time. Most orders are fulfilled within approximately 2–5 business days before shipment, although fulfillment times may vary.

Shipping methods, rates, and estimated transit times depend on the product and destination and are displayed at checkout when available. Delivery dates and transit times are estimates and are not guaranteed.

Orders containing multiple products may be fulfilled or shipped separately and may arrive in more than one package.

We are not responsible for delays caused by shipping carriers, customs processing, severe weather, service disruptions, incorrect or incomplete addresses supplied by the customer, or other events outside our reasonable control.

If an order arrives damaged, defective, or incorrect, or if you believe a shipment has been lost in transit, contact us so we can review the issue in accordance with our Refund Policy and work with our fulfillment partner or shipping carrier when appropriate.

SECTION 6 - RETURNS, REFUNDS, AND REPLACEMENTS

Because products are made to order specifically for the customer, we do not accept returns or exchanges for incorrect size selection, change of mind, buyer’s remorse, or ordering the wrong color or design. Please review product details and size charts carefully before ordering.

If an item arrives damaged, defective, or incorrect, contact us within 30 days of delivery at support@houseofflameandfantasy.com. Include your order number, photographs showing the issue, and a brief description. When a qualifying claim is approved, we will work with our fulfillment partner to provide an appropriate replacement or refund at no additional cost to the customer.

Nothing in these Terms limits rights or remedies that cannot lawfully be limited under applicable consumer-protection law.

SECTION 7 - INTERNATIONAL ORDERS

House of Flame & Fantasy currently ships to the United States, Canada, the United Kingdom, Ireland, Australia, and New Zealand, subject to availability and checkout eligibility.

International delivery may take longer because of customs processing or local postal services. Customs duties, VAT, import taxes, or other fees required by the destination country are the customer's responsibility unless expressly stated otherwise at checkout.

For damaged, defective, incorrect, or potentially lost-in-transit international orders, contact us at support@houseofflameandfantasy.com so we can review the issue and work with our fulfillment partner or shipping carrier as appropriate.

SECTION 8 - INTELLECTUAL PROPERTY

The Services, including our original trademarks, branding, text, displays, graphics, product designs, photographs, video, audio, and the selection and arrangement of such materials, are owned by House of Flame & Fantasy, our licensors, or other applicable rights holders and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, non-commercial purposes. Except as permitted by law or with prior written permission from the applicable rights holder, you may not reproduce, distribute, modify, republish, publicly display, publicly perform, download, store, or transmit protected material from the Services.

Shopify's names, logos, products, and service marks belong to Shopify or its applicable rights holders. Other third-party names and marks belong to their respective owners.

SECTION 9 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, integrations, or other functionality offered by third parties. Those services may be governed by their own terms and privacy policies.

To the extent permitted by law, House of Flame & Fantasy is not responsible for third-party services that we do not control. You should review the applicable third party's terms before using those services.

The Services may contain links to websites or services operated by third parties. We are not responsible for the content, accuracy, availability, policies, or practices of third-party websites that we do not control.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

House of Flame & Fantasy is powered by Shopify, which enables us to provide the online store Services. However, sales and purchases made through our store are transactions directly with House of Flame & Fantasy.

By using the Services, you acknowledge that Shopify is not the seller of House of Flame & Fantasy products and is not responsible for the products sold by House of Flame & Fantasy, except to the extent otherwise required by applicable law or expressly provided by Shopify for a Shopify service.

We may remove content that we reasonably determine is unlawful, abusive, fraudulent, infringing, or otherwise violates these Terms.

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.

We reserve the right to correct errors, update information, and, where permitted by law, cancel or adjust an affected order. If an error materially affects an order you have already placed, we will make reasonable efforts to contact you.

SECTION 15 - PROHIBITED USES

You may use the Services only for lawful purposes. You may not use the Services to violate applicable laws; infringe intellectual-property or privacy rights; transmit malicious code; engage in fraud, phishing, spam, harassment, impersonation, or deceptive conduct; interfere with the security or operation of the Services; or collect personal information unlawfully.

You may not use automated systems, scraping tools, bots, agents, or similar technologies to access the Services in a manner that violates applicable law, these Terms, or technical restrictions placed on the Services.

We may restrict or terminate access where we reasonably determine that these Terms have been violated.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. PRODUCT-SPECIFIC RIGHTS AND REMEDIES, INCLUDING RIGHTS RELATING TO DAMAGED, DEFECTIVE, OR INCORRECT ITEMS, ARE ADDRESSED IN OUR REFUND POLICY AND ARE SUBJECT TO APPLICABLE LAW.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

SECTION 19 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOUSE OF FLAME & FANTASY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES OR PRODUCTS, EXCEPT WHERE SUCH LIABILITY CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

Nothing in these Terms excludes or limits liability or consumer rights that cannot be excluded or limited under applicable law.

SECTION 20 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless House of Flame & Fantasy and its affiliates, owners, officers, employees, contractors, licensors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or your violation of another person's rights.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies and terms incorporated by reference, constitute the agreement between you and House of Flame & Fantasy concerning use of the Services.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations where permitted by applicable law.

These Terms and any separate agreements through which we provide Services are governed by applicable federal law and the laws of the State of Colorado, without limiting any mandatory consumer protections that apply based on a customer's location.

Any dispute will be handled in a court or forum with lawful jurisdiction over the matter.

You can review the current version of these Terms on our website.

We may update these Terms from time to time by posting a revised version. Where applicable law requires notice of a material change, we will provide that notice. Changes become effective on the date stated in the notice or, if no date is stated, when posted, subject to applicable law.
